Petition Filed Against EPA Green House Gas Findings
US – A supreme court petition has been filed against the Environmental Protection Agency’s (EPA) finding that greenhouse gases (GHG) are dangerous to public health and welfare.Disputes were made through the District of Columbia Circuit Court of Appeals headed by the National Cattlemen’s Beef Association (NCBA) who joined forces with the Coalition for Responsible Regulation.
Both the ‘timing’ and tailoring’ rules that govern permits at stationary sources of GHG and the proposed limitations on GHG from passenger vehicles have been challenged.
Concerns also surround emissions standards for cars and light-duty trucks and the worry of the NCBA is that EPA are acting above their station.
“We have already seen many actions by this administration’s EPA that proves they believe they are above the law. Forcing these greenhouse gas regulations upon Americans, including hard-working cattlemen and women is yet another example of this,” said NCBA Deputy Environmental Counsel Ashley McDonald. “We remain hopeful that bringing this issue to the highest court in the nation, the U.S. Supreme Court, will put a stop to the aggressive agenda-driven bullying by EPA.”
Mr McDonald added that NCBA originally challenged EPA and the GHG regulations in court in order to take regulatory rule-making power away from those sitting behind desks in a federal agency and place it back into the hands of the American people.
“The Clean Air Act is not an appropriate vehicle to regulate greenhouse gases and we are certain this manipulation of the Act goes against congressional intent. Once again, EPA continues to promulgate regulations which have a negative impact on producers’ ability to provide safe and affordable food for our nation and the world,” said Mr McDonald.
The EPA ‘endangerment’ findings link back to December 2009 and served to provide grounding for greenhouse gas regulations under the Clean Air Act.
Supreme Court decisions are now all eagerly awaited by the NCBA which hopes legislative actions put a stop to the EPA’s lobbying activity.
